Last Tuesday (July 30), the Department of Prizes and Betting of the Ministry of Finance (SPA/MF) published Ordinance No. 1,207, dated July 29, 2024. The document defines technical requirements for online betting games and live studio games, outlining the necessary criteria for the certification of each type of game.

The ordinance addresses the lottery modality of fixed-odds betting, including games such as slot machines, crash games, blackjack, roulette, among others. However, it only pertains to bets placed online, even if with live dealers, and continues to prohibit offering this type of game in a physical format. One definition in the ordinance is that a player will be considered inactive and their session will be terminated after 30 minutes of inactivity.

Among the defined criteria is that the game “must be random in nature, with the result determined by a random number, symbol, figure, or object generator, and must provide the bettor with payout tables covering all possible winnings before placing bets.” The game must be fixed-odds, showing, at the time of the bet, the multiplication factor that will determine the amount to be received by the player in case of a win.

According to a note published by the SPA/MF regarding the ordinance, the aim of the defined rules “is to protect bettors through rules that ensure honesty and transparency in games. It is based on international guidelines related to the themes of security and reliability of operation, used in the main markets for these games.” Based on these criteria, certifiers recognized by the SPA will determine whether a specific game can be offered in the Brazilian market.

Another important definition in the rules deals with what are not considered fixed-odds online games. The list of formats to which the rules do not apply includes: “skill games, fantasy sports, multiplayer games (games where the bettor’s actions or results are influenced by the result or action of another bettor), and peer-to-peer (P2P) betting games (where the betting operator does not get involved in offering the game, providing only the environment for bettors’ use).”

Brazil could become the third largest gaming market in the world if Bill (PL) 2.234/2022, which authorizes the operation of casinos, bingo, and “jogo do bicho” (a popular lottery game), is approved. This estimate comes from the Federation of Hotels, Restaurants, and Bars of the State of São Paulo (Fhoresp).

According to Fhoresp, legalizing the market in the country would bring investments of over R$ 382 billion into the sector, boosting Brazilian tourism. Last Wednesday (20), the bill was approved by the Senate’s Constitution and Justice Committee (CCJ) with 14 votes in favor and 12 against, and now proceeds to the Senate floor. If approved, it will only need the sanction of President Luiz Inácio Lula da Silva to become law.

The expectation is that the topic will be debated on the Senate floor during the second half of this year, according to Fhoresp. The federation also states that even before the text was approved by the CCJ, 56 foreign companies in the field had already visited Brazil to scout locations and regions for potential operations.

“The vote indicates that the Senate is in favor of bringing new investments to Brazil, which has everything to become a competitive destination in the gaming sector, generating jobs and income, including for bars and the hospitality and gastronomy sectors,” celebrates Edson Pinto, executive director of Fhoresp.

The Director of Hospitality and Gaming at Fhoresp, Bruno Omori, spoke about the types of gaming establishments that could be part of the Brazilian format. The most comprehensive and well-known model is the casino integrated with a resort, similar to what happens in Las Vegas, USA, and Macau.

“In proportion, the state of São Paulo could have up to three casinos in this format, as it has more than 40 million inhabitants. Rio de Janeiro and Minas Gerais will each have two units, as they both have over 20 million residents. In the other states, there will be one establishment of this type each,” calculates the Director of Hospitality and Gaming at Fhoresp. Tourist casinos, in a smaller format, and bingo halls would also be part of the market.

On Wednesday (19th), the Senate’s Constitution and Justice Committee (CCJ) of Brazil approved Bill (PL) 2.234/2022, which legalizes gambling in Brazil. This includes the operation of casinos, bingo, video bingo, and Jogo do Bicho, as well as allowing bets on horse races.

The approval passed with a vote of 14 to 12, and the text now moves to the Senate Plenary for consideration. The bill had already been approved by the Chamber of Deputies in 2022 and outlines the rules for the exploitation of these activities in Brazil, also establishing aspects such as regulation, control of the games, and related taxation.

If the text is approved as it stands in the Senate Plenary, it will only need the sanction of President Luiz Inácio Lula da Silva to become law. According to the Senate News Agency, the bill’s rapporteur, Senator Irajá, stated that investments in the sector could reach R$ 100 billion. It is also estimated that around 1.5 million direct and indirect jobs could be created, and R$ 22 billion in tax revenue could be generated, according to the rapporteur.

The prohibition of gambling in Brazil was enacted in a 1946 law, banning the practice nationwide. If it becomes law, PL 2.234/2022 provides various specific rules for different types of games. For example, casinos will only be allowed to operate in tourist hubs, integrated leisure complexes, or on vessels, with a limited number of licenses per state.

Regarding bingo, the game may be conducted in both card and electronic or video bingo formats but only in permanent locations (bingo halls). The bill also states that only one bingo hall will be permitted per municipality, while larger cities will be authorized one establishment for every 150,000 inhabitants.
